Protecting Employee Rights

LABOR ABUSE LAWYER

Modern day labor abuse lawyers represent employees in cases about sexual harassment, unpaid wages, and wrongful termination. Some wrongful termination lawsuits are about the violation of an employee safety standard, or protected rights such as the right to be absent from work due to cancer, disability, FMLA, or pregnancy. Labor abuses also include harassment based upon race, ancestry, ethnicity, or national origin.

In the form of wage and hour law, labor abuses include:

. bonuses promised and not paid
. commissions not paid
. fake alternative work week (AWS) agreements designed to avoid overtime
. lunch break violations
. minimum wage
. not paying an employee for all hours worked
. prevailing wage rates not paid
. rest breaks not allowed
. unpaid on-call work schedules
. unreimbursed expenses

Child labor law violations, under the table cash payments, and a refusal to allow the filing for workers compensation are also common labor abuses.

OUTRAGEOUS LABOR LAW VIOLATION ABUSES SEEN BY A VETERAN LAWYER

This is something our lead attorney wrote some years back. "Below is the Court of Appeals in Riverside. I was here today arguing an appeal. This is the Court of Appeals in Riverside. I was here today arguing an appeal.

The wrongful termination case involved a truck driver not allowed to get off his truck for in excess 28 days. He did not get a day off during the drive. The truck did not stop other than for refueling. The truck lacked bathroom facilities, or more than an 8 by 8 place he could sleep while the other driver drove. The truck driver was never put back onto the schedule after he requested, 'Home time' and got off the truck for a few days after asserting his right to get a day off in seven.
This is one of the most outrageous labor abuses I have seen in some time.

Riverside Labor Abuse Lawyer

The trucking industry is ripe with labor abuses due to recent rulings about pre-emption.

Second up is the hospital industry. Requiring hospital staff to remain standby while paying them nothing, or a sub-minimum wage is modern day slavery. The Employment Lawyers Group has tried multipe on-call cases in recent years including for nurses.

Overall, very strange pay practices are often labor abuses.

The Employment Lawyers Group has also recovered money for low wage workers who are forced to drive their vehicles throughout the day for their employer, and they are not reimbursed mileage. In fact, they have a published appeal involving an apartment maintenance man who had to drive his truck for work without being paid. Cases about not reimbursing employees for expenses include materials to do the job, out of town travel, and cell phones amongst others.

Equally abusive are employers who attempt to get their employees to pay them money. The Employment Lawyers Group won a judgment against a gas station in which the cashier was fired for not repaying a cash register shortage. They even had a client who was asked to pay back money taken during an armed robbery on her shift.

The Employment Lawyers Group are also handling a class action in which they employer monetarily fines employees. These fines occur if an employee uses their cell phone while at work. The employer also requires the employees to deposit $500 in event the employee gets into a car accident while working. These types of fines violate the California Labor Code and lead to PAGA fines.
